JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402,120B of the Indian Penal Code and 25(1-B)a 26,35 of the Arms Act. Petitioner is in jail custody since15.10.2018 on the accusation that he as well as others assembled to make preparation for committing dacoity.

Admittedly, nothing was recovered from conscious possession of the petitioner nor petitioner does have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.32857 of 2019(2) dt.20-05-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Begusarai in connection with Barauni P.S. Case No. 486 of 2018.
