JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2015 Petitioner is languishing in custody since 11.03.2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.
The robbing of the motorcycle of the informant led to the registration of the present case against unknown. The name of the petitioner sprang up on confession of the co-accused during investigation.
It is submitted by learned counsel for the petitioner that neither petitioner has been put on test identification parade nor anything has been recovered from the possession of the petitioner. A statement to that effect has been made in para 12 and 13 of the petition.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
Patna High Court Cr.Misc. No.22519 of 2015 (2) dt.19-05-2015 2/2 Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 535 of 2014.
Since the petitioner is accused in five other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
