====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------- 12-07-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Jadia P.S. Case No.45 of 2015 registered under Section 392 of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioners submits that the petitioners are not named in the F.I.R. and on mere suspicion they were taken into custody in this case on remand on 06.01.2016 by the police and, thereafter, the police got recorded the confessional statement of the petitioners showing their involvement in this case. Except the confessional statement

Patna High Court Cr.Misc. No.19035 of 2016 (3) dt.12-07-2016 2/2 of the petitioners, there is nothing to connect the petitioners in the commission of the alleged offence. It is further submitted that while the informant has detailed about the physique of the culprits but the petitioners have not been put on T.I. Parade till date. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Supaul, in connection with Jadia P.S. Case No.45 of 2015. Out of the two sureties, one must be close relative of the petitioners, who will file an affidavit giving genealogy as to how he/she is related with the petitioners. The bailors will undertake to furnish information to the court about any change in the address of the petitioners.
