JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 16.02.2015 in a case registered for the offences punishable under Sections 323, 354(B), 504/34 of the Indian Penal Code and Section 4 of The Prevention of Children from Sexual Offences Act.

It is alleged that petitioner and one Kishan Kumar Yadav were making attempt to outrage the modesty of Minu Kumari and when the informant made protest then informant was assaulted and abused by calling caste name. The victim girl in her 164 Cr.P.C statement has also supported the accusation.

It is submitted by learned counsel for the petitioner that even assuming the accusation levelled in the First Information Report as well as in the 164 Cr.P.C statement of the victim girl, the offence under Section 354(B) of the Indian

Patna High Court Cr.Misc. No.24644 of 2015 (2) dt.24-07-2015 2/2 Penal Code is not made out. Moreover the investigation has already concluded.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Madhubani in connection with Laukaha P.S. Case No. 220 of 2014, G.R. No. 21 of 2014.
