JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code.
Petitioner is named in the first information report but it is the case of prosecution that it was co-accused, Manoj Paswan who gave khanti blow causing head injury to the deceased and thereafter, co-accused, Pappu Paswan started raining lathi on the deceased. So far as petitioner is concerned, omnibus allegation of assault to injured persons of this case has been levelled against him. Petitioner is in jail custody since 13.02.2016 and the investigation against him appears to have been completed.
Patna High Court Cr.Misc. No.18866 of 2016 (2) dt.04-05-2016 2/2 Moreover, the alleged occurrence appears to have taken place on account of land dispute and petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Pushpendra Pandey, Judicial Magistrate 1st Class, Begusarai in connection with Matihani P.S.
