Having regard to the nature of allegation against the petitioner for the offences punishable under Sections-406, 409 and 420 of the Indian Penal Code, this Court apart from taking into account that the petitioner is also named accused in capacity of Branch Manager, of Co-operative Credit Swablambi Sahkari Samiti Ltd., and that he is also an accused in similar case being Dumra P.S. Case No. 07 of 2014, would find him not entitled for privilege of anticipatory bail even if he has come out with a defence that such payment was to be
Patna High Court Cr.Misc. No.24687 of 2015 (3) dt.24-08-2015 made by the co-accused Manish Madhav. Let it be noted that co-accused Manish Madhav had been arrested, and thus at best, the petitioner also expect only grant of regular bail.
Thus, keeping in view the nature allegation as also criminal antecedent of the petitioner, the prayer for anticipatory bail of the petitioner is hereby rejected. Nothing said in this order, however, will come in the way of the petitioner in surrendering before the Court below and seeking regular bail.
It also goes without saying that if the petitioner surrenders before the Court below and seeks regular bail, his prayer for regular bail should be considered on its own merit without being prejudiced by anything said in this order.
