The petitioner apprehends his arrest in Bhabua Mahila P.S. Case No.18 of 2021, registered for the offences punishable under Sections 354, 456 and 323 of the Indian Penal Code. The petitioner is said to have tried to outrage the modesty of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the occurrence took place on 07.03.2021, but the FIR was lodged on 12.03.2021 after delay of five days without any explanation. It is further submitted that the petitioner and the informant are co-villagers and due to petty

Patna High Court CR. MISC. No.44348 of 2021(2) dt.15-04-2022 2/2 dispute over a piece of land belonging to Anavad Sarv Sadharan, the petitioner has been made accused in the case. It is submitted that both sides claim their possession on the land. It is further submitted that the petitioner has got no criminal antecedent as stated in paragraph 3 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Kaimur (Bhabua) in connection with Bhabua Mahila P.S.
