2. The petitioner is apprehending her arrest in a case in connection with Sindhugarh P.S. Case No. 12 of 2026 dated 28.01.2026 registered for the offences punishable under Sections 126(2), 115(1), 74, 75, 78, 108, 352, 351(2) and 3(5) of the B.N.S.
3. As per the allegation, one Sanoj Yadav started teasing the sister of the informant while she was returning from the coaching center and tried to commit rape upon her. It has further been alleged that her sister anyhow came running to the house and informed the informant. It has been further alleged that, in the meantime, Sanoj as well as petitioner, who happens to be the mother of Sanoj, came at the house of the informant

It has further been alleged that in the midst thereof, the brother of Sanoj, namely, Shivdhar Yadav started abusing the wife of the informant. It has further been alleged that during the intervening quarrel, the sister of the informant got mentally upset and went inside the house and committed suicide by her dupatta.

Learned counsel for the petitioner has submitted that the only allegation against the petitioner, who happens to be the mother of co-accused Sanoj is to the effect that she asked the sister of the informant not to shout and as such, the same cannot be read as an allegation of abatement to suicide against the petitioner. It has further been submitted that it was a general conduct even if the allegation are accepted to be true and the deceased sister of the informant committed suicide in a heat of passion and spur of moment. It has further been submitted that there is no allegation that any of the accused persons, including this petitioner, did any acts either in words or action so that it may be reason to commit suicide. It has further been submitted that co-accused Sanoj Yadav is in judicial custody. It has lastly been submitted that petitioner, who is a lady, has got no criminal antecedent.
5. Learned A.P.P. for the State has vehemently
Patna High Court CR. MISC. No.34347 of 2026(2) dt.18-05-2026 3/3 opposed the prayer for anticipatory bail of the petitioner.
6. Heard the parties and perused the record.
7. Considering the facts and circumstances of the case, let the above named petitioner, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Sherghati, Gaya, in connection with Sindhugarh P.S. Case No. 12 of 2026, subject to conditions as laid down under section 482(2) of the B.N.S.S.
8. The application stands allowed.
