JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 324 of the Indian Penal Code.

It is alleged against the petitioner that he assaulted with dagger on the abdomen of the informant.

It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. The medical report suggests lacerated wound caused by hard and blunt substance whereas the petitioner alleged to have assaulted with dagger. For the occurrence of 28.07.2015, the FIR was registered on 20.08.2015 and the informant was medically examined on 29.07.2015. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.18830 of 2016 (2) dt.03-05-2016 2/2 Considering the accusation is not being corroborated by medical opinion, delayed lodging of the FIR and delayed medical examination of the informant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Begusarai in connection with Sahebpur Kamal P.S. Case No.340/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
