JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 149, 323, 324, 307, 379, 384,504, 506,427,326 of the Indian Penal Code and section 27 of the Arms Act.

As per prosecution case informant loading sand on a truck, in the meantime 15 to 20 persons including the petitioners came there and assaulted with lathi, Danda and brick and also snatched money ,I.D card, Driving licence, Pan card Adhar Card.

Patna High Court CR. MISC. No.44534 of 2021(3) dt.24-03-2022 2/2 Learned counsel for the petitioner submits that petitioners have falsely been implicated in this case. No specific allegation levelled against the petitioners. There is general and omnibus allegation against these petitioners. Petitioners have got clean antecedent.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Giriyak P.S Case No. 149 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
