NILU AGRAWAL ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Siwan Mufassil (Dhanauti O.P.) P.S. Case No. 14/2016 registered for offences punishable under Sections 341, 323, 354 (B), 387, 447, 504, 506/34 of the Indian Penal Code.
The prosecution case is on the basis of written report of the informant before the S.H.O. stating therein that the petitioner and other co-accused assaulted and abused the informant, Sukhrajo Devi and also tried to outrage her modesty. It has been submitted by the learned counsel for the petitioner that the petitioner and the informant are Pattidars and dispute arose between them on account of installation of hand
Patna High Court Cr.Misc. No.17825 of 2016 (2) dt.05-05-2016 2/2 pump. Learned counsel submits that petitioner has no criminal history.
Learned counsel for the petitioner submits that the allegation of assault levelled against the petitioner is completely false and it is property dispute in which the petitioner has been falsely implicated.
However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Mufassil (Dhanauti O.P.) P.S. Case No. 14 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C. (Nilu Agrawal, J) Sudha/- U T
