The petitioners seek bail in anticipation of their arrest in connection with Chousa P.S. Case No. 339 of 2019 dated 09.12.2019 instituted for the offences under Sections 341, 323, 324, 379, 504, 506 and 34 of the Indian Penal Code.

The accusation against the petitioners and others is of assaulting the informant. However, one of the co-accused persons viz. Ranjan is said to have assaulted the informant by means of a spade leading to injuries. So far as the petitioners are concerned, there is no specific accusation against them.

There is a counter version of the occurrence as well which was lodged by petitioner no. 2 earlier to the subject FIR.

Considering the aforenoted facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj at Madhepura in connection with Chousa P.S. Case No. 339 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
