JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2015 Petitioner is languishing in custody since 16.09.2014 in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code, Section 17 of the Criminal Law Amendment Act and Sections 16, 17, 18, 19, 20 of the Unlawful Activities(Prevention) Act. The prosecution case is that from the possession of Md. Shams one bullet proof jacket was recovered along with Samsung mobile. The said Md. Shams suggested that he purchased the bullet proof jacket from the petitioner. Subsequently the petitioner was apprehended who suggested that he purchased the said bullet proof jacket from one army personnel namely Amresh Sharma.
It is submitted by learned counsel for the petitioner that admittedly the recovery has not been made from the petitioner and except confession before the police, there is nothing against the petitioner and the investigation has already

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya in connection with Trial No. 1 of 2015, arising out of Rampur P.S. Case No. 269 of 2014.
