The petitioner has put to challenge an order dated 13.01.2021 passed by the Sub-Divisional Officer-CumLicensing Authority under the Bihar Targeted Public Distribution System (Control) Order, 2016, whereby the petitioner's licence to run a PDS shop has been cancelled. Learned counsel for the petitioner has urged that there was no proposal for cancellation of licence mentioned in the

Patna High Court CWJC No.13955 of 2021(3) dt.22-04-2022 2/2 show cause notice, which is a condition precedent in accordance with Clause 27(ii) of the said Control Order. Be that as it may, the petitioner has remedy of appeal against the said impugned order, which has not been availed. This application is, accordingly, disposed of with an observation that the petitioner shall be at liberty to prefer an appeal against the impugned order, with an application seeking condonation of delay. If such an appeal is preferred within four weeks from today, the Court expects the appellate authority to decide the petitioner's appeal expeditiously within the timeframe prescribed under the Control Order.
