The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The petitioner and other accused persons are alleged to have assaulted the wife of the informant and when Ram Bharos Sahani, son of the informant, went to save her, Chhotelal Sahani and Ranjit Sahani are alleged to have assaulted Ram Bharos Sahani with bamboos on his head. It is submitted that there is omnibus and general allegation of assault. There is a land dispute between the parties and, moreover, the case is compromised, but from perusal of the post-mortem-report, it appears that two injuries were found on the head and blood started oozing out from both the injuries and, on account of the injuries found on the head, Ram Bharos Sahani died. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail in Chiraiya P.S. Case No. 99 of 2014. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of a copy of this order.
