JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner and learned APP for the Sate.

The petitioner wants to renew his prayer for bail, which was earlier rejected vide order dated 15.10.2015 passed in Cr. Misc. No. 28175 of 2015, on the ground that the petitioner is in custody since 03.05.2015 having no criminal antecedent and trial has not been concluded up-till-now and in near future it is not likely to be concluded. Learned APP opposes the prayer of bail.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of bail, again prayer of bail of the petitioner stands rejected.

However, learned trial court is again directed to expedite the trial and conclude the same as early as possible after keeping in mind the amended proviso of Section 309 Cr.P.C.
