Petitioner seeks bail in a case registered for the offences punishable under Sections 409, 420, 120B/34 of the Indian Penal Code.

Petitioner was Block Development Officer at the relevant time and the only accusation against him is that he sanctioned the amount without verifying the work of executive agent. Moreover, co-accused, Md. Sekh Rasool @ Sheikh Rasool, who happens to be executive agent as well as co-accused, Ram Naresh Prasad @ Ram Naresh Singh, who happens to be Junior Engineer, have already been granted privilege of bail. Considering the aforesaid facts and circumstances as

No.18562 of 2016 (3) dt.03-05-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 818 of 2014.
