The petitioner is languishing in custody since 14.10.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 323, 506, 384 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the petitioner and others came, demanded extortion of Rs.1,00,000/-, snatched Rs.10,000/- from the informant and assaulted. The accused persons also gave life threatening in case of non-payment of Rs.90,000/- extortion money.
It is submitted by learned counsel for the petitioner that there is land dispute between the petitioner and the
Patna High Court Cr.Misc. No.15578 of 2015 (02) dt.19-05-2015 2/2 informant from before and there is nothing on the record that the informant was medically examined. The investigation has already concluded. The petitioner is accused in two other cases. Moreover, similarly situated accused Ravo Yadav and Praful Patel have been granted bail vide Cr. Misc. Nos. 45059 of 2014 and 48928 of 2014.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Udakishunganj, District - Madhepura in connection with Alamnagar (Ratwara) P.S.
