2. The present application has been filed for quashing the order dated 08.06.2018 passed by the learned Civil Judge, Junior Division, Sahpur Patori, Samastipur in Partition Suit No. 55 of 2014 by which the learned Civil Judge has rejected the petition dated 02.04.2018 filed by the petitioner for amendment of plaint.

3. The amendment of the petitioner has rightly been rejected by the Court below as the proposed amendment will chance the nature of the suit.

4. This application is disposed of with liberty to the petitioner to withdraw the suit and file a fresh suit as per the relief he claimed.

5. This application is disposed of.
