JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner is accused in connection with Bheldi P.S. Case No. 03 of 2016 registered under Section 379 of the I.P.C. Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner and one coaccused Jitendra Manjhi have come on the basis of the information given by the spy. Thereafter, house of the petitioner and one Jitendra Manjhi are said to be searched, fromwhere 18 articles are said to be recovered but it would appear from the seizure list, only one Lava Mobile is said to be recovered whereas in the F.I.R. allegation is about theft of 8 pieces mobile of Intex Company and
Patna High Court Cr.Misc. No.17932 of 2016 (2) dt.03-05-2016 2/2 7 pieces of Lava Company. Moreover, petitioner and co-accused Jitendra Manjhi used to reside in separate house but the seizure list shows about joint recovery. It is also submitted that petitioner is in custody since 10.01.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Saran at Chapra in connection with Bheldi P.S. Case No. 03 of 2016. Out of two sureties, one surety must be parents or close relatives of the petitioner.
