JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code.
Petitioner is named in the first information report but no specific overt-act has been attributed against him and according to prosecution case itself, it were co-accused, Kislai Kumar and Sudhir Kumar, who opened fire on the deceased persons. Admittedly, in the alleged occurrence, one Dharmendra Kumar @ Ajay Raj sustained injury. The statement of aforesaid Ajay Raj was recorded at P.M.C.H, Patna and in the aforesaid statement, the
Patna High Court Cr.Misc. No.18021 of 2016 (2) dt.29-04-2016 2/2 above stated injured did not name the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S. Case No. 180 of 2015.
