Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner, the State and the informant.

The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 379 and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner took away 16 years old informant's daughter with intention to marry her. He also took away ornaments from her house.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. In Section 164 Cr. P. C. statement of the victim, she has stated that out of family dispute, she had gone to the house of her relative at her own sweet will. Petitioner has claimed clean antecedent and he is in custody since 15.10.2020.

Patna High Court CR. MISC. No.44393 of 2021(3) dt.03-01-2022 2/2 Learned counsel for the informant opposes the prayer for bail submitting that the petitioner is alleged to have abducted minor girl of the informant.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Majhauliya Police Station Case No. 689 of 2020.
