Petitioners are accused in connection with Adapur P.S. Case No. 165 of 2015 registered under Sections 302 and 201/34 of the I.P.C.
The allegation against the petitioners and one Rupkali Devi is of committing the murder of the deceased, fatherin-law of the informant by pressing his neck with lathi. Learned counsel appearing on behalf of the petitioners submits that in fact, the deceased used to reside separate to the informant and she consumed poison. In course of investigation, Thimate was also found in his house. Learned
Patna High Court Cr.Misc. No.19570 of 2016 (2) dt.05-05-2016 2/2 counsel for the petitioners further submits that co-accused Rupkali Devi has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 811 of 2016 on 11.01.2016. It is also submitted that petitioner has no criminal antecedent and is in custody since 03.03.2016.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Raxaul at Motihari, East Champaran in connection with Adapur P.S. Case No. 165 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioners. (Rajendra Kumar Mishra, J) Shail/- U T
