1. Heard the Learned counsel for the petitioner.

2. Shri Mritunjay Kumar, the Learned counsel appearing for Lal Bihari Das, reported to the Court that during the pendency of the Writ petition, respondent No. 6 resigned. Subsequently, he was selected and is now running the PDS shop and he intends to file an impleadment petition to implead himself as one of the respondents.

On perusal of the prayers, it is evident that the Writ petition was initially filed challenging the illegality and mala fide conduct of the respondent No. 2 and further for quashing the selection of private respondent No. 6. However, during the pendency of the Writ petition, respondent No. 6 resigned, and one Lal Bihari Das was selected for the PDS shop. Therefore, there is a necessity for the petitioner to challenge the selection order of one Lal Bihar Das.

4. At this juncture, the Learned counsel for the petitioner intends to withdraw the Writ petition with liberty and leave to challenge the proceedings issued to Lal Bihar Das.

5. Accordingly, the Writ petition is dismissed as withdrawn giving liberty and leave to challenge the orders of the respondent No. 2 granting license for the PDS shop to Lal Bihari Das. (G. Anupama Chakravarthy, J) Amandeep/- U
