This application for anticipatory bail arises out of Civil Lines P.S. Case No. 352 of 2018 for the offence punishable under Sections 401, 141 and 420 of the Indian Penal Code. Based on a secret information, the police are said to have attempted to apprehend two persons, moving in suspicious circumstances likely to misuse several ATM cards, which they had allegedly stolen. On seeing the police, they started fleeing away, one of whom was apprehended. Niranjan Kumar is said to have confessed before the police and on his statement before the police 1214 ATM cards were recovered. He disclosed the name of this petitioner as his accomplice.

Learned counsel appearing on behalf of the petitioner has submitted that co-accused Niranjan Kumar has been granted regular bail as would be evident from the order of the learned

Patna High Court CR. MISC. No.32226 of 2019(2) dt.15-05-2019 2/2 Additional Sessions Judge 1st, Gaya, whereby the petitioner's application for grant of anticipatory bail has been rejected. Considering the submission that co-accused Niranjan Kumar has been granted regular bail from whose possession ATM cards were recovered, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in Civil Lines P.S. Case No. 352 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
