Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) and other sections of the Bihar Prohibition and Excise Act.

As per the prosecution case, 5 liters of liquor and other articles have been recovered from a field.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as the field in question does not belong to him. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner claims clean antecedent.
