The petitioner seeks bail in connection with Buxar (Industrial) P.S. Case No. 36 of 2019 registered for the offence punishable under Sections 341, 323, 467, 468, 471, 406, 420, 120(B), 376 and 511/34 of the Indian Penal Code. Informant is said to have deposited Rs. 4 lakh in the Divyang Jan Kalyan Seva Sansthan and on the date of occurrence, when the informant went in the office of the aforesaid finance company and demanded back her money, petitioner along with three other named accused persons assaulted her and tried to outrage her modesty, but she was saved on arrival of her mother and sister responding hulla made

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He was not present at the time of occurrence at the place of occurrence. As a matter of fact, the petitioner had transported the informant by his vehicle in the said finance company and has been falsely implicated in this case merely because he refused to become the prosecution witness. There is no evidence of depositing any money in the aforesaid finance company by the informant. Allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent and has been languishing in custody since 07.03.2019. Director of the aforesaid company, namely, Krishna Mohan Singh @ Krishna Mohan has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 01.05.2019 passed in Cr. Misc. No. 28263 of 2019.

On the other hand, learned APP for the State opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned
