The petitioner is languishing in custody since 17.03.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 307, 379, 504 and 506 of the Indian Penal Code.
It is alleged that the petitioner and others came variously armed and assaulted the informant. On protest being made the petitioner assaulted the brother of the informant on his head with the butt of rifle whereas Ajay Yadav assaulted with lathi and when the brother of the informant fell down then others assaulted.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.25607 of 2015 (2) dt.23-07-2015 2/2 petitioner that though the injury has been found to be grievous but there is counter version of the occurrence and there is no accusation of repeating the blow. Moreover, investigation has already concluded.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Nawadah in connection with Sessions Trial No. 145 of 2015/28 of 2015 arising out of Warsaliganj P.S.
