The petitioner apprehends his arrest in a case registered for the offences punishable under Section 135 of Indian Electricity Act.

Learned senior counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the petitioner was found committing theft of electricity leading to revenue loss of Rs. 7,59,625/- to the power holding company.

Patna High Court CR. MISC. No.34926 of 2022(2) dt.28-11-2022 2/3 Learned senior counsel for the petitioner submits that petitioner is willing to deposit 25% of the alleged loss and for the rest he will contest.

Learned counsel appearing for the power holding company does not oppose the prayer for anticipatory bail application of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lakhisarai P.S. Case No. 883 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Further, the learned trial court before accepting the bail bonds of the petitioner shall verify whether the said amount as agreed by the petitioner has been paid or not.
