====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-09-2023 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code.

3. As per prosecution case, on the alleged date and time of the occurrence, while the informant along with his son was working in the field, these petitioners armed with various weapons came there and began to abuse them. On protest, these

Patna High Court CR. MISC. No.35692 of 2023(4) dt.18-09-2023 2/2 petitioners assaulted the informant and his son as a result of which they sustained injuries.

4. It is submitted that both parties are gotiyas and there is land dispute between them for which Title Partition Suit No. 262 of 2019 is pending in the court of Sub-Judge-I, Patna City which was filed by petitioner Nos. 2 and 3 jointly against the informant and others. It is next submitted that though there is allegation of assault against these petitioners but no grievous injury has been found.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna City in connection with Didarganj P. S. Case No. 11 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
