JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-02-2021 Heard learned counsel for the petitioner and Mr. Arun Kumar Singh No.5, learned A.P.P. for the State. The petitioner, in the present case, is seeking regular bail in connection with Bhagwanpur Hat P.S. Case No. 111 of 2020 registered for the offence under Sections 302 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case merely on suspicion. Learned counsel submits that there is no specific allegation of assault against the petitioner and there is no eye witness to the alleged occurrence. It is submitted that the petitioner has no criminal antecedent and he is in judicial custody since 19.06.2020.

Patna High Court CR. MISC. No.34134 of 2020(6) dt.09-02-2021 2/2 is present and has opposed the prayer for regular bail of the petitioner.

Having regard to the facts and circumstances of the case, the seriousness of the offence and the materials particularly that the dead body of the deceased was recovered from the house of the petitioner and the doctors who had conducted the post-mortem have found death caused due to hemorrhage and shock due to liver and spleen rapture caused by hard and blunt substance and the allegations have also been corroborated by the statement made in course of investigation by the witnesses, this Court is not inclined to grant privilege of regular bail to the petitioner. His prayer for regular bail is thus refused.

Let the trial be expedited. The trial court is expected to proceed with the trial without granting any unnecessary adjournment. It is expected that the prosecution shall cooperate in early conclusion of the trial.
