However, Mr. Vikash Kumar, the learned Advocate for the BISCOMAUN submits that the order passed by the learned single Judge on 24.04.2007 in CWJC No. 9043 of 2006 was questioned in Letters Patent Appeal.
The Appellate Court (LPA No. 778 of 2007) vide order dated 21.04.2008 accepted the statement of the respondent/BISCOMAUN that payment shall be made to the employees on a pro rata and chronological basis as and when the funds are made available to the Society.
Mr. Kumar submits that the payments are being made but this only subject to chronological order of persons who are being paid and on receipt of funds. Pursuant to the afore-noted order passed in LPA, several persons have been paid and the petitioners shall also be paid in due course.
