The petitioner is in custody in a case registered under Sections 420, 467, 468, 471, 472, 489(K), 489(Kha), 120B,34, 124(A), 121(A) of the Indian Penal Code.
The prosecution case, in brief, is that on confidential information, the informant along with other police personnel searched the house of the petitioner from where forged court fee stamp, non-judicial stamp etc. were seized.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 26.03.2013. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against
Patna High Court Cr.Misc. No.35490 of 2015 (3) dt.06-10-2015 2/2 the petitioner. The petitioner has been made accused in this case due to mistake of fact. The other co-accused has been granted bail by the court below itself.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Vth, Patna, in Ram Krishna Nagar P.S.case No. 151 of 2013.
