2. The petitioner is apprehending his arrest in connection with Gardanibag P.S Case No. 701 of 2024 registered for the offences punishable under Sections 318(4), 336(3), 338, 340(2), 112(2) of the B.N.S. and Section 10 of the Bihar Public Examination Prevention of Unfair Means Act 2024.
3. As per the prosecution case, during the biometric verification of the candidate, one Sonu Kumar was found to be not complying with the said verification. On inquiry, he revealed that he had not sat for the written examination and he further disclosed that the written

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case and apart from the confessional statement of the candidate there is nothing against the petitioner. It is lastly submitted that the petitioner has clean antecedent as stated in para 3 of the bail petition.

Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner and stated that the petitioner is alleged to have impersonated himself in place of one Sonu Kumar in the written examination of Central Selection Council Constable Recruitment Bihar, Patna, hence, he does not deserve the liberty of anticipatory bail as his custodial interrogation is necessary which would reveal the further facts and material as to how such offence was being committed.

Considering the aforesaid facts and circumstances of the case, the prayer for anticipatory bail of the petitioner is hereby rejected and the petitioner is directed to surrender before the Court below concerned within four weeks from the date of this order and pray for regular bail, the learned Court below may consider the prayer for regular bail of the petitioner in
Patna High Court CR. MISC. No.33122 of 2025(3) dt.13-08-2025 3/3 accordance with law and on its own merits without being prejudiced by this order.
