The petitioner seeks bail in connection with Alauli P.S. Case No. 17 of 2020, dated 22.01.2020, instituted for the offence under Section 392 of the Indian Penal Code.

It has been submitted on behalf of the

Patna High Court CR. MISC. No.33532 of 2020(2) dt.16-12-2020 2/3 petitioner that though he has been named in the F.I.R., but similarly situated accused persons have been granted bail by a Bench of this Court. It has further been submitted that the motorcycle of the nephew of the informant, which is said to have been snatched away, has not been recovered. It has further been submitted that nothing incriminating has been recovered from the possession of the petitioner. The petitioner is stated to be in custody since 06.02.2020.

Regard being had to the period of custody of the petitioner and taking into account that in all cases in which he was earlier made accused, he is on bail, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Khagaria in connection with Alauli P.S. Case No. 17 of 2020 (G.R. No. 212 of 2020).

Considering the tainted background of the

Patna High Court CR. MISC. No.33532 of 2020(2) dt.16-12-2020 3/3 petitioner, this Court directs that in case he is made accused in another case of similar nature, the bail granted to him in this case shall be liable to be cancelled.
