JUSTICE SUDHIR SINGH ORAL ORDER 19-08-2015 The petitioner is languishing in custody since 31.1.2015 in connection with Ballia P.S. Case No.455 of 2014 for the offences instituted under Sections 384, 386, 307/34 of the I.P.C. and Section 27 of the Arms Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that there is allegation of plunder and rangdari in the shops of the informant and others including firing and assaulting upon the father of the informant and workers.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.1.2015 and the charge sheet has been submitted in the present case. The petitioner is not named in
Patna High Court Cr.Misc. No.24778 of 2015 (3) dt.19-08-2015 2/2 the F.I.R.. His name has come in course of investigation. It is further submitted that the petitioner may be released after completing nine months in custody since 31.1.2015. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released, after completing nine months in custody, on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Prakash, J.M., 1st Class, Begusarai, in connection with Ballia P.S.
