JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 17.10.2015 in a case registered for the offences punishable under Section of the Indian Penal Code and sections 20,22,23,24,27A and 29 of the NDPS Act.

It is alleged that two persons namely Lal Mohammad and Chhathu Sah were apprehended from whose possession 4 kilograms of charas each were recovered. Name of the petitioner sprang up when it was disclosed that the petitioner used to in contact with the apprehended accused through mobile and earlier the apprehended accused supplied contraband to the petitioner. It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.18690 of 2016 (2) dt.29-04-2016 2/2 that admittedly recovery has been made from two co accused persons but the petitioner was not apprehended on spot. Though the petitioner is accused in two other cases one of them registered under the NDPS Act but the petitioner has not been sent up for trial in one of those cases while acquitted in other. It is further submitted that the investigation has already concluded. Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah, West Champaran in connection with Gopalpur P.S. Case No. 140 of 2015.
