JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner, learned counsel appearing for Union of India as well as learned Additional Public Prosecutor for the State.

At the very outset, it is pointed out by learned counsel appearing for the Union of India through Director of Revenue Intelligence that investigation of present case i.e. Case No. DRI-7 MRU/15 has already been taken up by National Investigation Agency by the order of Government of India, Ministry of Home Affairs.

Learned counsel for the petitioner submits that at the time of filing of the present petition, petitioner was not aware about the above stated development but he fairly concedes that if

No.18604 of 2016 (3) dt.03-05-2016 2/2 the National Investigation Agency has taken up the investigation of this case by valid order of the Government of India, then this petition is not maintainable and this court may dispose of this petition giving liberty to petitioner to take appropriate step before the appropriate forum.

In view of the aforesaid submissions, this petition stands disposed of giving liberty to petitioner to raise his grievance before the appropriate forum in accordance with law. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
