1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No. 201 of 2023 registered for the offences punishable under Sections 448, 307, 326, 504 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on account of dispute, Satyendra Singh fired causing injury on his thigh and petitioner assaulted by butt of katta on forehead of Birendra Singh causing injury.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case being son of Satyendra Singh, who is own brother of informant and

No.43589 of 2023(2) dt.23-08-2023 2/3 Birendra, it is next submitted that though there is allegation of assaulting Birendra by the petitioner by butt of pistol but then the injury is not specified, it is further submitted that the petitioner came to be implicated only for the reason to coerce Satyender into submission.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that there is specific allegation against this petitioner of assaulting Birendra by butt of pistol causing injury on forehead.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ara Nawada P.S. Case No. 201 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

7. However, the learned trial court before accepting the bail bonds of the petitioner shall verify the injury report of Birendra Singh and in the event, if it is found that the injury
