Petitioner seeks bail in a case registered under section 376 and other allied sections of the Indian Penal Code. Informant is married lady and her husband was alive at the time of alleged occurrence but even then, she gave her consent to the petitioner to establish physical relation with her. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge II, Katihar in Sessions Trial no. 55/2016 arising out of Kursela P.S. Case no. 164/2015.
