This is an application for bail in a case of misuse. Initially the case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act when the petitioner was granted bail. The bail bond of the petitioner was cancelled on 30.01.2009 and now the petitioner is in custody since 10.03.2015.

It is submitted by learned counsel for the petitioner that the petitioner is 72 years of age and now he will appear regularly before the learned court below. The impugned order does not reflect the progress from the date of institution of the case to the date of

Patna High Court Cr.Misc. No.15606 of 2015 (02) dt.20-05-2015 2/2 default made by the petitioner or any progress since the petitioner is now in custody.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional District & Sessions Judge-III, Munger in connection with Sessions Trial No. 77A of 2008 arising out of Harpur P.S. Case No. 04 of 2006. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
