The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-A)B, 26/35 of the Arms Act.

It is a case of recovery of illegal country made weapon and preparation of dacoity. Four persons were apprehended who disclosed their name as Sujeet Kumar, Naveen Kumar Singh, Raj Kishore Mukhiya and Lakhindra Kumar @ Sikandar Kumar. Co-accused Lakhindra Kumar @ Sikandar Kumar disclosed the name of the petitioner as a person who fled away from the place of seizure.

No.35172 of 2022(2) dt.28-11-2022 2/2 It is submitted by learned counsel for the petitioner that petitioner is quite innocent and he has falsely been implicated in the present case. It is also submitted that petitioner was neither apprehended from the spot nor anything incriminating has been recovered from his conscious possession. It is further submitted that petitioner has no concern with the co-accused persons.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 482 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) nirajkrs/- U T
