The petitioner is accused in connection with Rail Sasaram (Deehari) P.S. Case No. 06 of 2016, registered under Section 379/34 of the Indian Penal Code.

The accusation is that on 29.01.2016 in course of traveling of the informant in Sampark Kranti Express, Train No. 12820, when he was sleeping, he woke up on hearing hulla, then saw one person was apprehended by the people, who was trying to take away the bag. When the informant looked about his bag, then it was found missing. The apprehended person disclosed his name as Sonu Rathour (Petitioner), he also disclosed the name of his associates as Ajay Kumar Nut and Ashok Nut, who got down from the train after taking bag at Dehri Railway Station.

Patna High Court Cr.Misc. No.17802 of 2016 (2) dt.02-05-2016 2/2 Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. Further submission is that nothing incriminating articles have been recovered from the possession of the petitioner. Further submission is that, in fact, due to taking the seat in the bogy an altercation took place and due to ulterior motive petitioner has been implicated in this case. The petitioner is in custody since 01.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Railway Magistrate, Gaya in connection with Rail Sasaram (Deehari) P.S. Case No. 06 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
