Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-b)A, 26 of the Arms Act.

One country made pistol and four live cartridges along with one stolen C.D. engine are said to have been recovered from the house of the petitioner but admittedly, petitioner was neither caught on the spot nor the aforesaid recovery was made from conscious possession of the petitioner. No doubt, petitioner carries criminal antecedent but he is languishing in jail custody since 05.02.2016 and the investigation against him has already

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 96 of 2015.
