====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-02-2021 Heard learned counsel for the petitioners and learned APP for the State.
Learned counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
The petitioners are apprehending their arrest in a case
Patna High Court CR. MISC. No.33199 of 2020(2) dt.24-02-2021 2/3 registered under Sections 147, 341, 323, 326, 307, 325, 379, 504/34 of the Indian Penal Code and 27 of the Arms Act. Allegedly, while the informant was going to market for purchasing the vegetables, in the way, all the accused persons armd with weapon, started abusing on the road and also assaulted him. While the brother of the informant came to rescue, he was also assaulted, as a result of which, the informant's brother sustained injury. The other persons were also assaulted.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case due to oblique reason. So far petitioner No. 1 is concerned, he is alleged to have given a farsa blow on the head of the informant. So far as petitioner Nos. 2 to 8 are concerned, general and omnibus allegation has been made against them. No specific overt act is alleged against the them. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R. There is specific allegation against the petitioner No. 1.
Considering the aforesaid facts and circumstances of the
Patna High Court CR. MISC. No.33199 of 2020(2) dt.24-02-2021 3/3 case, the prayer for anticipatory bail of the petitioner No. 1 is rejected. Let the petitioner Nos. 2 to 8, above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, District-East Champaran in connection with Ghorasahan P.S. Case No. 126 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
