3. As per the prosecution story, the police, on secret information, raided the place near the Panchayat Bhawan and there is recovery/seizure of 115 liters of country-made wine. This led to the FIR.
4. Learned counsel for the petitioner submits that he has been falsely implicated only because of his criminal antecedent. The recovery is admittedly from an open place near the Panchayat Bhawan.
5. Further, learned counsel for the petitioner relied on
2/4 the judgment of the Full Bench of Hon'ble Patna High Court in the case of Ram Vinay Yadav vs. State of Bihar reported in 2019(2) PLJR 1089 wherein it has been held that an application for anticipatory bail in a case arising our of Bihar Excise and Prohibition Act can be maintained, despite the bar under Section 76(2) of the Act, if on the basis of allegation made in the FIR, no offence under the said provision is made out.
6. Learned APP, Ms. Shaheen Begum opposes the prayer submitting that he he has criminal antecedent.
7. Taking into account the submissions of the parties and the judgment in the case of Ram Vinay Yadav (supra), as also that the recovery/seizure is from the orchard and not from his conscious possession in that background this Court is inclined to extend him the privilege of anticipatory bail.
