At the very outset, Mr. Sanjay Kumar, learned counsel appearing on behalf of the petitioner very fairly submits that in view of the nature of allegations, he may be permitted to withdraw the application with liberty to raise all the grounds which have been raised in the instant application before the learned Trial Court at an appropriate stage by filing an

2. Mr. Arun Kumar Pandey, learned Addl. Public Prosecutor for the State is also present.
3. In view of the aforesaid submissions made on behalf of the petitioner, this application is disposed off with the liberty to the petitioner to file an appropriate application before the learned Trial Court at an appropriate stage, raising all the grounds taken in the instant application and the learned Trial Court is directed to consider the same, whenever an application is filed on behalf of the accused person, and decide the same purely on the merit of it without being prejudiced, in any manner, by the order of this Court.
