JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Konch P.S. Case No. 325 of 2019 for the offence under Section 414/34 of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act.

It is alleged that during search, a country made pistol and a stolen motorcycle was recovered from possession of the co-accused Nitesh Kumar. Nothing was recovered from exclusive possession of the petitioner. Petitioner is in custody since 06.11.2019.

Considering the fact that the petitioner is in custody since 06.11.2019, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on
