The petitioner has preferred this application for grant of regular bail in a case registered under sections 342, 307, 354B and 34 of the Indian Penal Code and sections 8 and 12 of the POCSO Act.
As per the prosecution case, it is stated that the petitioner took the daughter of the informant to her place and on some pretext left. Thereafter two boys came and made an attempt to strangulate her and misbehaved with her. It is submitted by learned counsel for the petitioner that the petitioner is a lady and has been falsely implicated in the case. The daughter of the informant and the boys were friends and well acquainted with each other. No offence under
Patna High Court CR. MISC. No.44438 of 2021(3) dt.22-02-2022 2/2 the POCSO Act is is made out. No overt act has been alleged against this petitioner. The petitioner is in custody since 4.6.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the material that has transpired in course of investigation, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Liberty is granted to the petitioner to renew her prayer for bail after six months.
