Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown. Petitioner is in custody since 24.12.2018. Investigation of the case is already complete. Petitioner was never put on Test Identification Parade during investigation of the case nor any incriminating article was recovered from his possession. Only on the basis of criminal antecedents, petitioner has been suspected in this case.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.32274 of 2019(2) dt.15-05-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Birpur Police Station Case No. 119 of 2018, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
